These Terms of Use (the “Terms”) govern your access to and use of Brushes App (the “App”), developed by Alena Zhylinskaya (the “Developer”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Use of the App
1.1 You may use the App for personal, non-commercial purposes only.
1.2 You agree not to use the App for any unlawful, harmful, or abusive activities.
1.3 You are responsible for ensuring that your use of the App complies with applicable laws in your jurisdiction.

2. Intellectual Property
2.1 All content, features, and functionality of the App (including but not limited to text, graphics, logos, and software code) are the intellectual property of the Developer and are protected by copyright, trademark, and other intellectual property laws.
2.2 You are not permitted to copy, modify, distribute, sell, or lease any part of the App without prior written consent from the Developer.

3. User Content
3.1 If the App allows you to create, upload, or share content, you retain ownership of your content but grant the Developer a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the operation and improvement of the App.
3.2 You agree not to upload or share any content that is illegal, offensive, or infringes on the rights of others.

4. Third-Party Services
4.1 The App may use third-party services (such as Firebase, Google Analytics, and Amplitude) for analytics and other functionalities.
4.2 The Developer is not responsible for the availability, accuracy, or content of third-party services and websites.

5. Disclaimer of Warranties
5.1 The App is provided “as is” and “as available” without warranties of any kind, either express or implied.
5.2 The Developer does not warrant that the App will be uninterrupted, error-free, or free of harmful components.


6. Limitation of Liability
6.1 To the fullest extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
6.2 Your sole remedy for dissatisfaction with the App is to stop using it.

7. Termination
7.1 The Developer may suspend or terminate your access to the App at any time for any reason, without prior notice.
7.2 Upon termination, your right to use the App will immediately cease.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions.

9. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated “Effective Date.”
